Creditcrest Apply
The application form as proof that reasonable inquiries were made. A bank statement shows what came in and went out. It cannot say what the loan is for, whether the job it shows ends next month, or how many people the wage feeds. Those take a question. Apply asks them, lets the lender change them, refuses a form that stops covering what the law requires, and seals what was asked and answered into a record that Compliance, Decisioning and Intent read.
Whose form was it?
Before this product, the application form’s content was Evercrest Finance’s. The 25 September 2026 handover marked the form versions 1.0 to 1.8, the loan-purpose list and the gambling questionnaire as that lender’s and did not carry them. Creditcrest had the machinery in LoanManager: a form as data, answers checked against the exact version and sealed. It had no questions, and nothing tied a question to the obligation it discharges. The questions below are Creditcrest’s own.

The Act names the two inquiries — requirements and objectives, and financial situation (National Credit Act s 130(1)(a), National Credit Act s 130(1)(b)) — and not their contents. The topics are ASIC’s reading of them in Regulatory Guide 209, which is guidance rather than law, and whose words — “will need” or “likely to need” — are shown beside each. Changes that are reasonably foreseeable are not in the Act’s text at all: they come from RG 209 and the Explanatory Memorandum, and hang on s 131(2)’s question of whether the consumer is likely to be able to pay. RG 209.61: “You will need information about the amount, frequency and source of income, and changes that are reasonably foreseeable.” © Australian Securities & Investments Commission: Reproduced with permission.
Other small amount credit is asked on the standard small amount form and is not required: the presumption it fed was repealed on 12 June 2023 and nothing replaced it. A lender may drop it without an exception.
2. A lender changes the form
The lender removes the three questions about what is going to change, and rewords the income question. 4 changes, each kept with the words before and after.
Refused
Nothing on the form asks about changes that are reasonably foreseeable, which the inquiries must cover for a secured car loan (National Credit Act s 130(1)(b)). Add a question, or record why it is not asked and have a second person approve that.
Refused again: the person who asked also approved
The exception for changes that are reasonably foreseeable does not stand: sales.manager asked for this change and approved it. A second person approves, or it is one person’s change. A form cannot be published leaving a required topic unasked until a second person has approved why.
Published, with the exception on file
A second person approved the reason: “Asked by the assessor on the call and recorded in the case notes instead of on the form.” Every record made on this form carries that reason and who approved it, where the question would have been.
